HOW TO REGISTER A PATENT



The requirements for filing a non-PCT application in Algeria are as follows:

  1. Name, address and nationality of the applicant;
  2. Power of Attorney in French (simply signed);
  3. Specification, claims, drawings, and abstract in French and Arabic;
  4. Assignment of Invention, if the applicant is not the inventor; and
  5. Certified copy of priority document, if applicable.

The minimum requirements for obtaining a filing date are: name, address, and nationality of the applicant; title in French; specification, claims, drawings, and abstract in English and either French or Arabic; and details of the priority application, if applicable (number, country, and filing date).  All other documents can be filed within a term of two months except for the certified copy of priority document which can be lodged within a term of three months.

The requirements for filing a PCT application in Algeria are as follows:

  1. Name, address and nationality of the applicant;
  2. Power of Attorney in French (simply signed);
  3. Copy of the specification, claims, drawings, and abstract as published by WIPO;
  4. Specification, claims, drawings, and abstract in Arabic;
  5. Copy of International Search Report together with Arabic or French translation thereof;
  6. Copy of International Preliminary Examination Report; and
  7. Copy of any changes recorded before WIPO during the International phase.

The minimum requirements for entering the National phase are: name, address, and nationality of the applicant; title in French; and a copy of the specification, claims, drawings, and abstract as published by WIPO.  All other documents can be filed within a term of two months.

We estimate that the cost of filing a patent application in Algeria will be about US$ 2300.00 (including the first year annuity).  To this must be added costs for claiming each priority date at about US$ 150.00 per priority claim, additional publication charges of about US$ 70.00 for every five pages of the description and claims over the first ten, and additional publication charges of about US$ 40.00 for every page of drawings over the first three.

In the case of a PCT National phase filing, outstanding annuities are normally payable upon entering the National phase (due retrospectively on the first anniversary of the International Filing date and annually thereafter) at a cost of about US$ 450.00 per annuity.

Furthermore, should we be instructed to prepare the necessary translations, our charges for translating from English into French are about US$ 30.00 per 100 words, and about US$ 40.00 per 200 words for translating from English into Arabic.


HOW TO REGISTER A TRADE MARK



1.   Filing requirements

  1. Full name, street address and description of the applicant (including trading style, if any, and state/country of incorporation, if incorporated)
  2. List of goods and/or services
  3. Clear print of device mark
  4. A simply signed power of attorney
  5. If priority is claimed: a certified copy of home application/registration

2.   Classification

  1. The 11th edition of the Nice classification of goods and services are followed
  2. Multi-class - Yes.

3.   General

  1. Duration : 10 years from date of application, renewable for further periods of 10 years (even if priority is claimed, the date is still calculated from application date)
  2. Use : Non-use for 1 year following registration makes the registration vulnerable to cancellation
  3. Marking : Not required.
  4. Licenses : Must be recorded.
  5. Assignments : Assignment of pending applications are permitted
  6. Searches available within approximately 5-10 weeks from instruction (not recommended)


HOW TO OBTAIN DESIGN PROTECTION



Design protection is obtainable via a national filing.  Algeria is a member of the International Convention.

The requirements for filing an application in Algeria are as follows:

  1. Power of Attorney - no legalisation or notarisation necessary;
  2. 7 sets of formal drawings; and
  3. Certified copy of priority document (if priority is claimed) together with a French translation thereof.

Please note that the documents listed under item (b) are required on the day of filing.

Items (a) and (c) can be lodged up to 2 months after filing.

Multiple design applications are available in Algeria.

Our cost estimate for filing a design application in Algeria is about US$ 1800.00.  To this must be added further costs of about US$ 50.00 per design, about US$ 90.00 for each figure filed and about US$ 60.00 for each priority claim.

The initial period of protection is 1 year from filing.  It is standard procedure to apply for a 9 year extension upon filing at an additional cost of about US$ 300.00 per design.

Should it be required, we can assist with the preparation of any translation from English to French at a cost of US$ 30.00 per 100 words.
