Information on the filing of Patents, Designs and trademarks
in Liberia

PATENT
REGISTRATIONS
Patent protection
is obtainable via a national filing. Liberia is a member of the International
Convention and of the PCT.
The requirements
for filing a non-PCT application in Liberia are as follows:
(a) Declaration
and Power of Attorney (notarized and legalized up to Liberian Consular
level);
(b) Deed of Assignment if the inventor(s) is/are not the applicant(s)
(notarized and legalized up to Liberian Consular level);
(c) A copy of the specification (including claims, drawings, and abstract)
in English; and
(d) A certified copy of the priority application and, if necessary,
a certified translation into English thereof.
Please note
that the documents listed under item (c) are required on the day of
filing. Items (a), (b), and (c) can be late lodged subsequent to the
filing date. However, for a surcharge of about US$ 250.00 we are able
to have your instructional letter legalized with the Justice of Peace
in Liberia which shall be accepted into evidence by the Registrar in
lieu of items (a) and (b).
The requirements
for filing a PCT application in Liberia are as follows:
(i) International
application number, international filing date and priority date;
(ii) Full name(s) and address(es) of the applicant(s), and full name(s)
of the inventor(s);
(iii) Declaration and Power of Attorney (notarized and legalized up
to Liberian Consular level); and
(iv) Deed of Assignment if the inventor(s) is/are not the applicant(s)
(notarized and legalized up to Liberian Consular level).
Items (i) and
(ii) are required at filing. Items (iii) and (iv) can be filed subsequent
to the entry into the national phase. However, for a surcharge of about
US$ 250.00 we are able to have your instructional letter legalized with
the Justice of Peace in Liberia which shall be accepted into evidence
by the Registrar in lieu of items (iii) and (iv).
The following
additional requirements may also be applicable if requested by the Registrar:
(v) If the international
application is not in English, a translation into English is required
together with a translation of any claim amendments and of any annexes
to the International Preliminary Examination Report in English;
(vi) If a certified priority document was not filed in the international
phase of the application, it must be filed and, if not in English, a
verified translation thereof is required; and
(vii) Copies of the International Advertisement, the International Search
Report, the International Preliminary Examination Report, and the Chapter
II Demand.
Our cost estimate
for filing a patent application in Liberia is between about US$ 2400.00
and US$ 2600.00 (excluding translation charges, if required). To this
must be added charges for attending to the payment of any outstanding
annual renewal fees (due retrospectively from the first anniversary
of the international filing date, where applicable) at a cost of about
US$ 450.00 per year.

REGISTRATIONS
1. Filing requirements
1.1 Full name,
street address and description of the applicant (including trading style,
if any, and state/country of incorporation, if incorporated).
1.2 List of goods and/or services.
1.3 A power of attorney, legalised up to Liberian Consular level.
1.4 A drawing of the mark.
2. Classification
2.1 The 45 classes
of the International Classification (Nice Agreement) are followed.
3. General
3.1 Duration
: 15 years from filing date and renewal for further periods of 15 years.
3.2 Use : Compulsory, within 2 years from registration.
3.3 Marking : Optional.
3.4 Licenses : Recordal of licenses are compulsory.
3.5 Assignments of applications are permitted.
4. Costs
4.1 Application:
First trade mark/class $1500.00, additional classes filed simultaneously
$1370.00 each.
4.2 Assignment : First trade mark/class $730.00, additional trade
marks/classes filed simultaneously $350.00 each.
4.3 Preparation of documents : $130.00.
4.4 Recordal of change of name or address : First trade mark/class $360.00,
additional trade marks filed simultaneously $195.00 each.
4.5 Licenses : First trade mark/class $740.00, additional trade
marks/classes filed simultaneously $395.00 each.
4.6 Renewal : First class $1100.00, additional classes renewed
simultaneously $970.00 each.
4.7 Searches : Not recommended
